Terms and Conditions

These Terms and Conditions ("Terms") govern the booking and provision of travel services by Wandera ("Wandera", "we", "us", or "our") to any person who books a trip with us ("the Traveller", "you", or "your"). By making a booking and paying a deposit, you acknowledge that you have read, understood, and agree to be bound by these Terms on behalf of yourself and all persons included in your booking.

1. About Wandera and the scope of our services

1.1. Wandera organises and operates small-group international travel experiences. In arranging your trip, we source and coordinate services provided by independent third-party suppliers, including but not limited to airlines, hotels, ground transport operators, and local activity providers.

1.2. We act as an organiser and coordinator of these services. Where services are performed by third-party suppliers, those services are also subject to the respective suppliers' own terms and conditions, including airline conditions of carriage.


2. Bookings and payment

2.1. A booking is confirmed only upon our receipt of the required deposit and complete traveller details. Until such time, no seat, price, or availability is guaranteed.

2.2. Booking Deposit: The deposit payable to confirm a seat allocation shall be as specified on the trip booking dossier or confirmation invoice (typically ₹10,000 to ₹15,000 per traveller for milestone schedules, or full settlement where opted).

2.3. Balance Payment Due Date & Default: The full remaining balance of the trip price must be cleared no later than thirty (30) calendar days prior to departure. If the balance is not received by the due date, Wandera shall issue a formal final payment notice granting a forty-eight (48) hour cure period. Failure to remit full payment upon expiration of this notice shall be deemed an immediate Traveller-initiated cancellation governed strictly by Clause 4.1(c). Wandera shall apply all deposits and milestone installments received to date toward actual non-recoverable third-party supplier commitments and the fifteen percent (15%) administration fee, with any remaining net balance, if any, handled in accordance with Clause 4.1(c).

2.4. All prices are quoted per person on a twin-sharing basis unless otherwise specified, and are inclusive only of those items expressly stated as included for the relevant trip.

2.5. Twin-Sharing Accommodation: All trip pricing is structured on a twin-sharing basis. Solo travellers will be paired with a fellow traveller of the same gender in twin-bedded rooms. Requests for single-occupancy lodging are subject strictly to hotel availability and must be settled directly by the traveller as a single-room supplement.


3. Taxes

3.1. Goods and Services Tax (GST) is levied at the prevailing statutory rate and is displayed at the time of booking.

3.2. Tax Collected at Source (TCS) applies to overseas tour packages in accordance with the Income-tax Act, 1961. TCS is collected at the applicable statutory rate at the time of payment. Travellers are required to furnish a valid PAN at the time of booking; in its absence, a higher statutory rate may apply.

3.3. Non-Refundability of Statutory TCS: In accordance with Section 206C(1G) of the Income-tax Act, 1961, once Tax Collected at Source (TCS) has been collected and remitted to the Government of India against the Traveller's PAN, it cannot be refunded by Wandera under any circumstances (including trip cancellation by either party). Following the conclusion of the relevant tax filing quarter, Wandera shall issue a Form 27D certificate (or challan details) allowing the Traveller to claim credit or a refund of the remitted tax when filing their annual Income Tax Return (ITR).


4. Cancellation by the Traveller

4.1. Cancellation by the Traveller and Refund Schedule: All cancellation notices must be communicated in writing to hello@wandera.in and shall take effect on the business day received by Wandera. Cancellations are governed strictly by the following schedule:

(a) Unconditional Money-Back Grace Period (applicable ONLY where departure is sixty (60) calendar days or more away):

(b) Standard Cancellation (between sixty (60) and thirty-one (31) days prior to departure):

(c) Late Cancellation (thirty (30) calendar days or fewer prior to departure): Due to the capacity-constrained nature of our 10-person expeditions, all airline PNR allocations, boutique hotel blocks, overland transit fleets, and festival permits are irrevocably committed thirty (30) days prior to departure. Consequently, for any cancellation initiated thirty (30) calendar days or fewer prior to departure, for any reason whatsoever (including personal emergencies, illness, visa delays, or schedule changes), Wandera shall deduct:

  1. All actual, non-recoverable commitments and cancellation charges incurred with third-party suppliers (airlines, accommodations, transport operators, and activity partners); and
  2. An administration and capacity reservation charge equal to fifteen percent (15%) of the total trip price to account for unallocated seat capacity, customer onboarding, and operational overhead.

Where any third-party supplier issues an actual cash refund to Wandera for a cancelled booking, such net recovered amount (less the 15% administration charge and non-refundable outlays) shall be promptly remitted to the Traveller. For cancellations arising from medical or personal emergencies, travellers must seek primary financial recovery through their mandatory comprehensive travel insurance policy.


5. Cancellation or modification by Wandera

5.1. Guaranteed Operation: Once an expedition route is officially published with confirmed departure dates, Wandera guarantees that the expedition will operate regardless of final group subscription numbers, subject only to events of Force Majeure (Clause 6). Wandera will not cancel a confirmed trip due to low participant numbers.

5.2. Itinerary changes. While itineraries are prepared with care, we reserve the right to make reasonable modifications to the itinerary, accommodation (to a comparable standard), or included activities where necessitated by weather, supplier availability, operational requirements, or circumstances beyond our reasonable control. We shall notify the Traveller of any significant changes at the earliest opportunity.

5.3. We recommend that Travellers refrain from incurring non-refundable ancillary expenses (such as visa fees or connecting travel) until the trip is fully confirmed and paid in full. We shall not be liable for such incidental costs in the event of a change or cancellation, save that, where a cancellation results from our own commercial decision, we shall address reasonable and documented out-of-pocket costs fairly and in good faith.


6. Force majeure

6.1. We shall not be liable for any failure or delay in performance, or for any cancellation, arising from events beyond our reasonable control, including but not limited to acts of God, natural disasters, adverse weather, epidemics or pandemics, war, civil unrest, terrorism, governmental action or advisories, border closures, strikes, and airline schedule changes or cancellations.

6.2. In the event that a trip cannot proceed due to such circumstances, we shall refund such amounts as we are able to recover from our suppliers, less any non-recoverable costs (and excluding non-refundable TCS). Where practicable, we shall offer the Traveller the option to reschedule or to receive credit toward a future trip, valid for twenty-four (24) months from the date of issue.

6.3. Travellers are strongly advised to obtain comprehensive travel insurance, which is intended to protect against losses arising from such events.


7. Passports, visas, and travel documentation

7.1. It is the Traveller's sole responsibility to hold a valid passport (with a minimum of six months' validity beyond the return date) and to obtain all visas and travel documentation required for the destination.

7.2. While we may provide general guidance and reasonable supporting documentation, we accept no responsibility for visa refusals, delays, or denial of entry by immigration authorities. No refund shall be due where a Traveller is unable to travel by reason of missing, invalid, or rejected documentation.

7.3. The Traveller is responsible for meeting all health, vaccination, and entry requirements applicable to the destination.


8. Insurance

8.1. We strongly recommend that every Traveller obtains comprehensive travel insurance covering, at a minimum, medical expenses, emergency evacuation, trip cancellation and curtailment, travel delay, loss of baggage, and personal liability, valid for the destination and full duration of the trip.

8.2. Travel undertaken without adequate insurance is at the Traveller's own risk. We accept no liability for any loss or expense that would ordinarily be recoverable under an appropriate travel insurance policy.


9. Traveller conduct and responsibilities

9.1. The Traveller agrees to conduct themselves responsibly, to comply with applicable laws and local customs, to follow the reasonable instructions of the trip leader, and not to endanger the safety or enjoyment of others.

9.2. We reserve the right to remove from the trip, without refund, any Traveller whose conduct, in our reasonable opinion, is unlawful, unsafe, or materially disruptive to the group.

9.3. The Traveller shall be responsible for any loss or damage caused by them to accommodation, transport, or third-party property, and shall settle such costs directly.

9.4. The Traveller must disclose, at the time of booking, any medical condition, dietary requirement, or accessibility need that may be relevant to their participation. Certain activities carry inherent risks; participation is voluntary and at the Traveller's own risk. The Traveller agrees to indemnify and hold Wandera harmless against losses arising from their own intentional misconduct, unlawful acts, or failure to disclose a relevant medical condition.

9.5. Festival Activities, Water Exposure, and Personal Electronics Waiver: Participation in festival itineraries (including Thailand's Songkran water festival) involves inherent exposure to water, dense crowds, and street environments. While Wandera provides complimentary protective gear (such as dry bags and phone pouches) as an operational courtesy, Wandera accepts no liability whatsoever for personal electronic damage, water ingress, device failure, physical loss, or theft. Travellers are solely responsible for ensuring their personal devices, cameras, and optical gear are properly sealed, handled, and privately insured.


10. Limitation of liability

10.1. We act as an organiser and coordinator of services provided by independent third-party suppliers. While we exercise reasonable care in the selection of such suppliers, we shall not be liable for the acts, omissions, defaults, or negligence of any independent supplier, nor for events beyond our reasonable control.

10.2. To the maximum extent permitted by applicable law, our total aggregate liability to the Traveller in respect of any trip shall not exceed the total amount paid by the Traveller to Wandera for that trip.

10.3. We shall not be liable for any indirect, incidental, or consequential loss, nor for any loss recoverable under an appropriate travel insurance policy.

10.4. Nothing in these Terms shall exclude or limit our liability for death or personal injury arising from our proven negligence, or any other liability that cannot lawfully be excluded or limited.


11. Personal data and media

11.1. Data protection. We collect and process personal data in accordance with the Digital Personal Data Protection Act, 2023. Personal data is used solely for the purpose of arranging and delivering your trip and meeting our statutory obligations. We do not sell personal data, and we share it with suppliers only to the extent necessary to deliver the services booked.

11.2. Marketing consent. We shall use photographs or video footage in which a Traveller appears for promotional purposes only where the Traveller has provided express, opt-in consent at the time of booking. In the absence of such consent, no such material featuring the Traveller shall be used.

11.3. Withdrawal of consent. A Traveller may withdraw marketing consent at any time, without affecting their booking, by contacting us in writing. We shall cease use of the relevant material in future promotional activity within seven (7) business days.


12. Governing law and jurisdiction

12.1. These Terms shall be governed by and construed in accordance with the laws of India.

12.2. The parties shall first endeavour to resolve any dispute amicably through good-faith discussions within thirty (30) days of written notice of the dispute.

12.3. Subject to Clause 12.2, the courts of New Delhi, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the services provided.


13. Acceptance

By paying a deposit for a Wandera trip, the Traveller confirms that they have read, understood, and accepted these Terms and Conditions on behalf of themselves and all persons included in their booking.
